HERITAGE
MANOR AND PICNIC GROVE CONTRACT/LEASE AGREEMENT
This
agreement is hereby made and entered into for the above-mentioned
date with the Management of above-mentioned facility and the Lessee.
Management reserves the right to determine which hall your party
will be in based upon the number of guests for your party. (Management
absolutely will not guarantee a specific hall.) At the time of the
contract signing, Lessee must give an approximate number of guests
for the party and if Lessee calls Management with a number of guests
which is far less than originally estimated, unabling Management
to rent the other facility, Management reserves the right to charge
Lessee for the additional guests.
The
aforementioned Lessee shall not use facilities for anything other
than original contracted agreement. The Lessee shall have no right
to let or sublet contracted facilities or equipment, nor move any
of said equipment from said premises, nor use of said equipment
for any other purpose other than which is provided for in contracted
agreement. While in control of said premises and equipment, Lessee
shall obey all City, County, State and Federal statutes, together
with any and/or all rules, regulations or special agreements of
said Management. In particular, any violation of gambling, lottery,
over indulgence of alcohol, and or substance abuse laws imposed
by City, County, State or Federal statutes, while on said premises
are under control of Lessee, and shall be the responsibility of
the Lessee to see that all unlawful activity be terminated immediately.
If Lessee is unable to do so, Management reserves the right (under
this agreement) to close said premises immediately. Management also
reserves the right to bring to said premises, personnel from any
authorized law enforcement agency (within the jurisdictions of said
premises) to enforce control of unlawful activity which has/had
been occurring.
Lessee
shall be held liable for any damage to furniture, equipment, furnishings,
structures, and/or building, real property (trees, shrubs, etc.)
and personnel of Heritage Manor (Heritage Club) caused by Lessee
and/or guests. Lessee will also be held liable to monies lost to
Management and to any of their contracted Lessee's who may be inconvenienced
by damage and/or repairs that are being performed. Also, Lessee
will be liable to any attorney and/or court fees that may be incurred
by Management, Heritage Manor (Heritage Club), and/or personnel
who contract any said attorney to recover any lost monies, fees,
wages, etc.
In
the event of unavoidable damage to said premises beyond the control
of the Management (any natural or weather disaster or damage incurred
through others wrongdoings), causing said premises to be uninhabitable
for any amount of time, shall deem this contracted agreement to
be null and void. In the event that any of these conditions herein
occur, Management reserves the right to close said premises without
notice to Lessee. However, Management can, if so desired, send written
notice (by registered mail) to Lessee regarding said condition of
the premises. Any monies received and deposited by Management from
Lessee for contracted date, shall be refunded in full. Management
is not obligated to provide an alternative premise nor provide any
refreshment of any kind for the Lessee.
In
the event Lessee must cancel for said contracted date, a full refund
of deposit will be made by Management if cancellation notice is
received (written or verbal) within ninety (90) days. If cancellation
notice is received within forty-five (45) days, one-half of the
deposit will be refunded. If cancellation is received with less
than thirty (30) days notice, Management reserves the right to keep
the deposit in full.
All
beverages to be used on said premises must be ordered and/or purchased
through Management. No alcoholic beverages, of any kind, will be
allowed to be brought onto said premises. EXCEPTION: Any organization
using said premises for a fundraising purpose and having bottles
of alcoholic beverages as part of or a raffle prize, shall be allowed
to do so. Said raffles prize(s) however, shall not be opened and/or
consumed on said premises. If this is witnessed by Management, then
Management reserves the right to confiscate said raffle prize and/or
remove said raffle prizewinner from the premises.
Lessee
has the permission to decorate said premises for the occasion. Lessee
should contact Management, prior to contracted date, to determine
what time the facilities will be available for the decorating. However,
Lessee must remove all decorations from said premises afterwards
and leave said premises in the same condition as found (being no
damage to walls or other structures from tape or other means of
decorating). If Management finds any damage prior to full payment
or within twenty-four (24) hours after contracted date, Management
reserves the right to bill Lessee for damages.
Overtime
for any party is not permitted unless Lessee agrees to pay Management
one and one-half times the regular pay rate for all personnel that
must remain. Also, in addition to that amount, the Lessee must pay
a minimum of $100.00 per half-hour for the bar to remain open. No
party will ever remain open past 12:00 a.m. (This is due to license
and insurance regulations.)
Management
requires that all guests and/or personnel contracted by Lessee for
entertainment purposes must exit facilities within a half-hour after
the conclusion of the contracted time.
